1. Obtención de datos personales y responsable del tratamiento

De conformidad con lo previsto en el Reglamento (UE) 2016/679, del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos, se informa al usuario del presente sitio web de que los datos de carácter personal que facilite a través del mismo, así como cualesquiera otros datos personales que pudiera facilitar en el futuro, serán objeto de tratamiento siendo la entidad responsable del mismo GRUPO MACIA HOTELES, S.L., con domicilio social en calle Zacatín, 25, 18001 – Granada, y con N.I.F. B-18920579, siendo la dirección de correo electrónico a efectos de comunicaciones la siguiente: lopd@maciahoteles.com

2. Finalidad y base jurídica del tratamiento de datos personales

MACIÀ le informa de que sus datos serán tratados con las siguientes finalidades:

i. Análisis de las interacciones del usuario
MACIÀ tratará los datos facilitados por el usuario a través del sitio web, así como sus interacciones en el mismo. En concreto, el tratamiento permitirá analizar los hábitos de navegación del usuario permitiendo ofrecer una navegación más ágil y personalizada, y detectar cualquier uso fraudulento del sitio web.
Base jurídica: el tratamiento es necesario para la satisfacción de los intereses legítimos de MACIÀ. El usuario tiene derecho a oponerse en cualquier momento a que sus datos personales sean tratados para esta finalidad, de acuerdo con el apartado 7 de esta política.

ii. Control informático del sitio web
MACIÀ tratará los datos facilitados por el usuario a través del sitio web, así como sus interacciones en el mismo, al objeto de detectar cualquier uso fraudulento del sitio web o pérdida de información.
Base jurídica: el cumplimiento de obligaciones legales de MACIÀ al objeto de asegurar la seguridad del sitio web y la información contenida en el mismo.

iii. Relación del usuario con MACIÀ
MACIÀ tratará los datos del usuario al objeto de mantener, desarrollar y dar cumplimiento a su relación con MACIÀ derivada de la contratación de cualquiera de los servicios que ofrece. En concreto, este tratamiento consiste en la gestión de reservas y estancias, contrataciones realizadas a través del sitio web, envío de notificaciones, atención de solicitudes y gestión de pagos y facturación.
Base jurídica: La ejecución de las relaciones contractuales que el usuario tenga con MACIÀ o con cualquiera de las sociedades de su grupo.
Cuando exista o haya existido relación contractual entre el usuario y MACIÀ, los datos del usuario también podrán tratarse para la remisión de comunicaciones comerciales (newsletters), generales o personalizadas, a través de cualquier medio, incluido el correo electrónico, SMS o cualquier medio de comunicación electrónica.
Base jurídica: el tratamiento es necesario para la satisfacción de los intereses legítimos de MACIÀ.El usuario tiene derecho a oponerse en cualquier momento a que sus datos personales sean tratados para esta finalidad, de acuerdo con el apartado 7 de esta política.

iv. Remisión de comunicaciones comerciales
MACIÀ podrá solicitar al usuario su consentimiento para remitirle comunicaciones comerciales (newsletters), generales o personalizadas, a través de cualquier medio, incluido el correo electrónico, SMS o cualquier medio de comunicación electrónica.
En todo caso, el usuario podrá oponerse a dicha remisión de comunicaciones comerciales indicándolo en la casilla correspondiente a tal efecto o, con posterioridad, podrá revocar su consentimiento comunicándolo a la siguiente dirección de correo electrónico: lopd@maciahoteles.com

v. Candidaturas de trabajo
En caso de que el usuario remita a Macià Hoteles su currículum vitae, los datos personales se tratarán al objeto de incorporar y gestionar su candidatura en procesos de selección de personal organizados por Macià Hoteles.
Base jurídica: el consentimiento del usuario. El usuario tiene derecho a retirar su consentimiento, en cualquier momento, al objeto de que sus datos personales no sigan siendo tratados para esta finalidad, de acuerdo con el apartado 7 de esta política.

3. Exactitud y veracidad

El usuario garantiza la veracidad y exactitud de los datos proporcionados a MACIÀ a través de los formularios correspondientes, exonerando a MACIÀ de cualquier responsabilidad al respecto y comprometiéndose a mantenerlos debidamente actualizados.

4. Datos personales de menores

Los menores de 14 años no deberán utilizar los servicios ofrecidos a través del sitio web sin el consentimiento de sus padres o tutores.
En caso de que MACIÀ detecte usuarios que pudieran ser menores de 14 años, se reserva el derecho a solicitar dicha autorización y/o copia de su documento acreditativo de identidad.

5. Plazo de conservación de los datos personales

Sus datos personales se conservarán hasta que hayan prescrito las acciones que pudieran derivarse de la relación con MACIÀ, salvo que exista obligación legal que amplíe el citado plazo de conservación.

6. Comunicación de los datos personales

MACIÀ podrá comunicar sus datos personales a:
i. Las sociedades de su grupo, tanto las titulares de hoteles(de conformidad con el punto 8 de la presente Política de Privacidad), al objeto de atender peticiones del usuario, como las que les prestan servicios de administración y gestión.
ii. Organismos Públicos competentes, Fuerzas y Cuerpos de Seguridad del Estado y Jueces y Tribunales, en cumplimiento de obligaciones legales.
iii. Prestadores de servicios que actúen como encargados del tratamiento.
No se prevén transferencias internacionales de los datos personales.

7. Ejercicio de derechos y reclamaciones

El usuario podrá ejercer los derechos en materia de protección de datos (acceso, rectificación o supresión, limitación, oposición y portabilidad) dirigiendo a tal efecto una comunicación mediante correo postal a calle Zacatín, 25, 18001 – Granada o enviando un correo electrónico a la dirección lopd@maciahoteles.com, indicando en ambos casos su nombre, apellidos y adjuntando copia de su documento acreditativo de identidad.

Sin perjuicio de lo anterior, el usuario tiene derecho a presentar una reclamación ante la Agencia Española de Protección de Datos.

Las sociedades anteriores serán responsables del tratamiento de los datos personales recabados a través de la formalización de reservas y estancias en los respectivos hoteles.
Al referido tratamiento le será de aplicación lo dispuesto en la letra iii del punto 2 anterior, así como lo dispuesto en los putos 3 y siguientes de la presente Política de Privacidad.

9. Política de Cookies
Remisión a Política de Cookies

TRATAMIENTO DE DATOS PERSONALES

De acuerdo con lo previsto en la Ley 15/1999, de 13 de diciembre, sobre Protección de Datos de Carácter Personal, el usuario acepta que los datos personales aportados en el momento de su reserva sean incorporados a un fichero titularidad de PROMOCIONES CONDOR SA, en adelante la empresa , con domicilio social en C/ Zacatin, 25 18001 Granada, para la gestión del sistema de reserva, la tramitación de su solicitud, el control y la gestión de la relación con los usuarios de la web que tramitan reservas, así como para la realización de estudios estadísticos de los usuarios registrados en la citada web que permitan diseñar mejoras en los servicios prestados. Todos los campos de los formularios señalados como obligatorios deben ser necesariamente cumplimentados para la correcta tramitación de sus solicitudes. Los datos personales que facilita, sólo serán comunicados a terceros en cumplimiento de obligaciones legales o con su previo consentimiento. El usuario consiente expresamente que los datos bancarios proporcionados sean utilizados para atender a las posibles penalizaciones ante cancelaciones o no presentación fijados en las condiciones de la tarifa. La tramitación de sus reservas implica necesariamente el tratamiento antes señalado, por lo que no se podrá llevar a cabo el proceso en caso de oposición al mismo.Usted puede, en cualquier momento, ejercer sus derechos de acceso, rectificación, cancelación u oposición según más abajo se indica.

VERACIDAD DE LOS DATOS

El usuario responderá, en cualquier caso, de la veracidad de los datos facilitados, reservándose la empresa el derecho a excluir de los servicios registrados a todo usuario que haya facilitado datos falsos, sin perjuicio de las demás acciones que procedan en Derecho.Asimismo, el usuario debe hallarse debidamente habilitado para facilitar datos de terceras personas. Sólo si cuenta con el consentimiento de los futuros huéspedes del hotel, el usuario podrá consignar sus nombres y apellidos en el apartado Distribución de habitaciones. Tal información, que permitirá al Hotel elegido procurarle un mejor servicio a sus huéspedes, es opcional, por lo que, su consignación por el usuario, implica, bajo su exclusiva responsabilidad, la asunción del deber de informar a aquellos del contenido de nuestra Política de Privacidad con carácter previo al ofrecimiento de la información personal.

TRATAMIENTO DE DATOS EN LA NAVEGACIÓN

De conformidad con la obligación prevista en el art. 22.2 de la Ley 34/2002, de 11 de julio, de servicios de la sociedad de información y comercio electrónico, se le informa de que la empresa utiliza cookies. Una cookie es un fragmento de información de texto que las webs transfieren al disco duro de los equipos que se conectan a ellas. Utilizamos cookies de sesión para identificar al usuario y mantener su estado de identificación. Las cookies de sesión se borran automáticamente del disco duro cuando finaliza la sesión. También utilizamos cookies para recopilar estadísticas anónimas y conjuntas que nos permitan analizar la forma en que los usuarios utilizan nuestra web, con el fin de mejorarla. Sólo se obtiene y se conserva la siguiente información acerca de los visitantes de nuestro web:

a) El nombre de dominio del proveedor (PSI) y/o dirección IP que les da acceso a la red. Por ejemplo, un usuario del proveedor xxx sólo estará identificado con el dominio xxx.es y/o la dirección IP. De esta manera podemos elaborar estadísticas sobre los países y servidores que visitan más a menudo nuestro web.

b) La fecha y hora de acceso a nuestro web. Ello nos permite averiguar las horas de más afluencia, y hacer los ajustes precisos para evitar problemas de saturación en nuestras horas punta.
c) La dirección de internet desde la que partió el link que dirige a nuestro web. Gracias a este dato, podemos conocer la efectividad de los distintos banners y enlaces que apuntan a nuestro servidor, con el fin de potenciar los que ofrezcan mejores resultados.
d)El número de visitantes diarios de cada sección. Ello nos permite conocer las áreas de más éxito y aumentar y mejorar su contenido, con el fin de que los usuarios obtengan un resultado más satisfactorio.

A nosotros nos permitirá obtener la siguiente información:
a) La fecha y hora de la última vez que el usuario visitó nuestro web.
b) El diseño de contenidos que el usuario escogió en su visita a nuestro web.
c) Elementos de seguridad que intervienen en el control de acceso a las áreas restringidas.

Si bien la información obtenida es, en principio, totalmente anónima, atendiendo al Informe 327/2003 de la Agencia Española de Protección de Datos, se les informa a los usuarios de que los datos antes relacionados serán incorporados a un fichero de datos de carácter personal de la empresa para las finalidades antes detalladas, pudiendo el usuario ejercitar sus derechos de acceso, rectificación, cancelación y oposición según más abajo se indica.

Empleamos igualmente la herramienta de remarketing de Google Adwords. Dicha herramienta permite publicar en la Red de contenido de Google (más detalles sobre la red de contenido de Google aquí: Adwords anuncios basados en visitas anteriores de usuarios a nuestra Web. Para ello, algunas de las páginas de nuestra web incluyen un código llamado “etiqueta de remarketing”. Estas etiquetas permiten leer y configurar las cookies de su navegador con el fin de determinar el tipo de anuncio concreto que se le mostrará al usuario, en función de elementos relacionados con su visita a nuestra web, como por ejemplo, el circuito de navegación escogido, las paginas concretas visitadas o las acciones que en las mismas se hayan realizado. Las listas de remarketing así creadas se guardan en una base de datos de los servidores de Google, donde se almacenan todos los ID de cookie asociados a cada lista o categoría de intereses. Respecto a la empresa, esta información sólo podrá ser asociada a un usuario concreto en caso de que dicho usuario esté identificado en la web, por ejemplo por haber finalizado éste un proceso de reserva. En este caso los datos así obtenidos serán comunicados a la empresa para fines de prospección comercial y de segmentación de los usuarios de la web para diseñar campañas comerciales de acuerdo a los interés mostrados durante la navegación, incorporándose los datos a un fichero de la citada entidad para las finalidades señaladas. Para oponerse al tratamiento y la comunicación antes señalados, el usuario tiene la posibilidad de deshabilitar las cookies, según a continuación se señala:

El usuario tiene la opción de no recibir cookies o de ser informado acerca de su fijación mediante la configuración de su navegador a tal efecto. FICHERO CON FINES PUBLICITARIOS

Si el usuario quiere recibir información sobre promociones del la empresa puede autorizar la cesión de sus datos a tales efectos simplemente aceptando esta política de Privacidad. Si, por el contrario, no desea recibir información al respecto deberá accionar expresamente la casilla de exclusión. Sólo cuando exista consentimiento para ello, los datos personales necesarios para la comunicación serán cedidos a Paraty Hoteles S.L y servirán para mantenerle informado, bien por correo electrónico, bien por cualquier otro medio, de novedades, productos y servicios relacionados con la empresa la empresa y Paraty S.L. Desde este momento se le informa de que, si así ha manifestado que es esa su voluntad, sus datos personales se incorporarán a un fichero con datos de carácter personal del que es responsable la entidad la empresa pudiendo el usuario acceder, cancelar, rectificar sus datos u oponerse a su tratamiento mediante escrito dirigido a la empresa según más abajo se indica.

DERECHOS

Los derechos de acceso, rectificación, cancelación y oposición podrán ejercitarse mediante escrito acompañado de una copia de su DNI dirigido al Responsable del fichero que corresponda en la dirección que más abajo se indica:

RESPONSABILIDAD DEL HOTEL

El acceso a la página no supone en ningún caso la existencia de una relación comercial entre usuario y la empresa. El portal únicamente suministra información acerca de las plazas hoteleras vacantes en el momento de solicitar la mencionada información, por lo cual si usted efectúa la reserva on-line, está contratando directamente con el hotel y no con el portal. La versión impresa de la reserva efectuada sirve de localizador cuando acuda al hotel.

La reserva de noches de hotel en este sitio web implica la adhesión y aceptación por parte del cliente de todas y cada una de las condiciones generales aquí expuestas.
Mediante la aceptación de las siguientes cláusulas, usted declara y acepta:

1) Ser mayor de edad y disponer de plena capacidad para efectuar la reserva, manifestando que entiende y comprende la totalidad de las condiciones que se encuentran en la página web.
2) Que los datos suministrados cuando efectúa la reserva on-line son verdaderos, completos y concisos.
3) Únicamente se encuentran comprendidas en la web aquellas páginas que figuran dentro del mapa web.
4) Que el acceso a esta página web es responsabilidad del usuario
5) Que una vez realizada la reserva se procederá al archivo del documento electrónico en que se ha formalizado, usted podrá acceder al mismo en cualquier momento.
6) Que confirma la reserva hecha, es decir, las fechas indicadas, el número de habitaciones, de personas y el Hotel escogido.
7) Las condiciones y precio de la reserva efectuada, son los que se determina expresamente en las condiciones de la tarifa incluidas expresamente en la página que usted hace la reserva.
8) Respecto a la relación con el portal, éste le da la posibilidad de reservar habitaciones del hotel elegido a través de su página web, pero no ofrece ningún tipo de prestación hotelera bajo su responsabilidad.
9) Que los datos de su tarjeta se recogen a efectos de garantizar la reserva. Si su reserva es en prepago, se realizará el cargo en el momento de hacer la reserva. De lo contrario deberá realizar el pago al llegar al hotel.
10) Las ofertas sólo serán válidas durante el tiempo que permanezcan accesibles a los destinatarios del servicio.

PRECIOS

Los precios que se indican son Precios Venta al Público I.V.A. incluido.

El precio incluye: Precio por noche en función del tipo de habitación y régimen seleccionados, a excepción de los hoteles en los que se indique específicamente la inclusión de otros servicios.

El precio no incluye: Cualquier servicio no especificado además de extras tales como traslados, propinas, llamadas telefónicas, servicios de lavandería, minibar, parking, etc…

El día de salida deben dejar libres las habitaciones a las 12 de la mañana como muy tarde.

PASAPORTES Y VISADOS

Todos los viajeros, sin excepción (niños incluidos), deberán llevar en regla su documentación personal y familiar correspondiente, sea el pasaporte o D.N.I., según la legislación vigente. Será por cuenta de los mismos cuando los viajes así lo requieran la obtención de visados, pasaportes, certificados de vacunación, etc. Los menores de 18 años deben llevar un permiso escrito firmado por sus padres o tutores, en previsión de que el mismo pueda ser solicitado por cualquier autoridad. Caso de ser rechazada por alguna Autoridad la concesión de visados, por causas particulares del usuario, o ser denegada su entrada en el país por carecer de los requisitos que se exigen, o por defecto en la documentación exigida, o por no ser portador de la misma, el hotel declina toda responsabilidad por hechos de esta índole, siendo por cuenta del consumidor cualquier gasto que se origine, aplicándose en estas circunstancias las condiciones y normas establecidas para el supuesto de no-show.

RESPONSABILIDADES: El hotel no se hace responsable de cualquier, accidente, robo, deterioro, etc… tanto de sus las personas como de sus enseres o vehículos.

TÍTULO IV: Derechos y obligaciones de las personas usuarias de servicios turísticos y de las empresas turísticas.

CAPÍTULO I: De las personas usuarias de servicios turísticos

Artículo 21. Derechos.

A los efectos de esta Ley y sin perjuicio de lo establecido en la legislación sobre defensa y protección de los consumidores y usuarios u otra que resulte aplicable, las personas usuarias de servicios turísticos tendrán derecho a:

a) Recibir información veraz, suficiente, comprensible, inequívoca, racional y previa a la contratación sobre los servicios que les oferten, así como sobre el precio final completo, incluido los impuestos, desglosando, en su caso, el importe de los incrementos o descuentos que le sean de aplicación a la oferta.

b) Obtener los documentos que acrediten los términos de su contratación.

c) Acceder a los establecimientos turísticos en los términos establecidos en la presente Ley.

d) Recibir los servicios turísticos en las condiciones ofrecidas o pactadas y, en todo caso, que la naturaleza y calidad de su prestación guarde proporción directa con la categoría de la empresa o establecimiento turístico.

e) Tener debidamente garantizada en el establecimiento su seguridad y la de sus bienes, así como su intimidad, en los términos establecidos en la legislación vigente, y ser informadas de cualquier inconveniente coyuntural que pudiese alterar su descanso y tranquilidad.

f) Recibir de la Administración turística la información, protección y auxilio cuando sea necesario para la defensa de sus derechos en sus relaciones con los proveedores de los servicios turísticos.

g) Ser informadas inequívocamente de las instalaciones o servicios que supongan algún riesgo y de las medidas de seguridad adoptadas.

h) Recibir factura o tique con el contenido previsto en la normativa vigente del precio abonado por el servicio turístico prestado.

i) Exigir que, en lugar de fácil visibilidad, se exhiba públicamente el distintivo acreditativo

de la clasificación, aforo y cualquier otra información referida al ejercicio de la actividad, conforme a lo establecido en la normativa correspondiente.

j) Formular quejas y reclamaciones y obtener información sobre el procedimiento de presentación de las mismas y su tratamiento.

k) Acudir a un sistema de mediación en materia de turismo a través de mecanismos de naturaleza arbitral.

l) Recibir de la Administración competente información sobre los distintos aspectos de

los recursos y de la oferta turística de Andalucía.

m) Recibir información sobre las condiciones de accesibilidad de recursos, servicios e infraestructuras turísticas.

n) Participar, a través de sus organizaciones más representativas, en los procedimientos de adopción de decisiones públicas que, relacionados con el turismo, pudieran afectarles.

Artículo 22. Obligaciones.

A los efectos de esta Ley, y sin perjuicio de lo establecido en otra legislación aplicable, las personas usuarias de servicios turísticos tienen la obligación de:

a) Observar las reglas de convivencia e higiene dictadas para la adecuada utilización de los establecimientos turísticos.

b) Respetar las normas de régimen interior de los establecimientos turísticos, siempre que no sean contrarias a la ley.

c) En el caso del servicio turístico de alojamiento, respetar la fecha pactada de salida del establecimiento dejando libre la unidad ocupada.

d) Pagar los servicios contratados en el momento de la presentación de la factura o en el plazo pactado, sin que el hecho de presentar una reclamación implique la exención de pago.

e) Respetar los establecimientos, instalaciones y equipamientos de las empresas turísticas.

f) Respetar el entorno medioambiental, el patrimonio histórico y cultural y los recursos turísticos de Andalucía.

TITLE IV: Rights and obligations of users of tourist services and tourist companies.

CHAPTER I: Users of tourist services

Article 21. Rights.

For the purposes of this Law and without prejudice to the provisions of the legislation on the defense and protection of consumers and users or other applicable legislation, users of tourist services will have the right to:

a) Receive truthful, sufficient, understandable, unequivocal, rational and prior to contracting information on the services offered, as well as on the complete final price, including taxes, breaking down, where appropriate, the amount of the increases or discounts that are applicable to the offer.

b) Obtain the documents that certify the terms of their contract.

c) Access tourist establishments in the terms established in this Law.

d) Receive tourist services in the conditions offered or agreed upon and, in any case, that the nature and quality of their provision is in direct proportion to the category of the company or tourist establishment.

e) Have their safety and that of their property, as well as their privacy, duly guaranteed in the establishment, in the terms established in current legislation, and be informed of any circumstantial inconvenience that could alter their rest and tranquility.

f) Receive information, protection and assistance from the Tourist Administration when necessary to defend their rights in their relations with providers of tourist services.

g) Be unequivocally informed of the facilities or services that pose a risk and of the security measures adopted.

h) Receive an invoice or ticket with the content provided for in the current regulations of the price paid for the tourist service provided.

i) Require that, instead of easy visibility, the accrediting badge be publicly displayed

of the classification, capacity and any other information referring to the exercise of the activity, in accordance with the provisions of the corresponding regulations.

j) Formulate complaints and claims and obtain information on the procedure for submitting them and their treatment.

k) Go to a mediation system in tourism matters through mechanisms of an arbitral nature.

l) Receive from the competent Administration information on the different aspects of

the resources and tourist offer of Andalusia.

m) Receive information on the conditions of accessibility of tourist resources, services and infrastructures.

n) Participate, through their most representative organizations, in public decision-making procedures that, related to tourism, could affect them.

Article 22. Obligations.

For the purposes of this Law, and without prejudice to the provisions of other applicable legislation, users of tourist services have the obligation to:

a) Observe the rules of coexistence and hygiene dictated for the proper use of tourist establishments.

b) Respect the rules of the internal regime of tourist establishments, provided that they are not contrary to the law.

c) In the case of the tourist accommodation service, respect the agreed date of departure from the establishment, leaving the occupied unit free.

d) Pay for the contracted services at the time of presentation of the invoice or within the agreed period, without the fact of submitting a claim implying exemption from payment.

e) Respect the establishments, installations and equipment of tourist companies.

f) Respect the environment, the historical and cultural heritage and the tourist resources of Andalusia.
